Please read carefully. These Terms limit our liability to you and require you to take responsibility for your AI agent and everything it does. By clicking to pay, subscribing, or continuing to use Your AgentSmith, you agree to all of the following. If you do not agree, do not use the service.

Alpha service. Your AgentSmith is an early-access, alpha-stage product. It is new and evolving, features change, models get upgraded, and things sometimes break. Your AI agent will make mistakes. You are signing up as an early adopter who accepts that this is not a polished, mature product. All sales are final — no refunds.

1. Your Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of the Your AgentSmith service, including your AI agent, the dashboard, our websites, and any related software or support (together, the “Service”). “You” means the person or organization using the Service; “we”, “us”, and “our” mean the Service and the people who operate it. By clicking to pay, subscribing to, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm that you are at least 18 years old and have the authority to accept these Terms on behalf of anyone you represent.

2. What the Service Is

The Service provides an automated, AI-powered software agent that generates text and other outputs and can perform tasks in response to your instructions, typically through Telegram and/or a dashboard. The agent is software. It is not a person, not an employee, not a professional adviser, and not a substitute for professional judgement.

3. Provided “As Is” — No Warranties

The Service is provided “as is” and “as available”, with all faults, and without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, security, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any output will be accurate, complete, current, appropriate, or fit for any purpose.

4. AI Outputs — No Reliance

Artificial intelligence is experimental and imperfect. The agent’s outputs are generated automatically and are not reviewed or verified by us. They may be inaccurate, incomplete, outdated, biased, offensive, or entirely fabricated (“hallucinated”), and the agent may misunderstand instructions or take unintended actions. Outputs are not professional advice of any kind — not legal, financial, tax, accounting, medical, safety, or other professional advice — and must not be relied upon as such. You are solely responsible for independently reviewing, verifying, and deciding whether to act on any output. We are not responsible for any decision you make or action you take based on the Service.

5. Your Responsibilities

You are solely and fully responsible for your agent and everything done with it. This includes, without limitation:

  • how you configure, instruct, and use the agent, and every output it produces and every action it takes at your direction or on your behalf;
  • all content, data, files, prompts, and information you or your contacts provide to the agent, and ensuring you have the right to provide them;
  • your Telegram bot and token, passwords, API keys, integrations, connected accounts, and keeping your credentials secure;
  • obtaining any consents and giving any notices required before you use the agent to communicate with, collect information about, or act toward any other person;
  • your compliance with all applicable laws, regulations, and third-party terms in your use of the Service; and
  • any use of the agent by anyone you allow to access it.

6. Acceptable Use

You must not use the Service to do anything unlawful, harmful, deceptive, infringing, defamatory, harassing, or fraudulent; to generate or distribute spam, malware, or unsolicited messages; to violate anyone’s privacy or intellectual-property rights; to build competing services; or for any high-risk purpose where failure could lead to death, personal injury, or serious property or environmental harm. You must not attempt to breach, probe, or circumvent the security of the Service or its infrastructure. We may suspend or terminate your access immediately, without notice or liability, if we believe you have violated these Terms or created risk or legal exposure for us or others.

7. Third-Party Services

The Service depends on third parties we do not control — including messaging platforms (e.g. Telegram), AI/model providers (e.g. DeepSeek, OpenRouter and others), payment processors (e.g. Stripe), and hosting providers. Your data and prompts may be processed by these third parties in order to operate the Service. We are not responsible or liable for their acts, omissions, outages, changes, pricing, data handling, availability, or termination, and their own terms and policies apply to their portions of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, we, our owner, operators, and affiliates will not be liable to you or anyone else for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business, or opportunity, arising out of or relating to the Service or these Terms, under any theory of liability, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you actually paid us in the one (1) month immediately before the event giving rise to the claim, or (b) US$50. These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the smallest amount permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Your AgentSmith and its owner, operators, and affiliates from and against any and all claims, demands, actions, damages, losses, liabilities, judgements, settlements, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) any output, action, message, or decision of your agent; (c) any content or data you provide; (d) your violation of these Terms or of any law or third-party right; or (e) any dispute between you and any third party connected to your use of the Service.

10. Assumption of Risk

You acknowledge that AI agents are experimental, that they can behave unpredictably, and that you are choosing to use one with full knowledge of these risks. You accept and assume all risk arising from your use of the Service.

11. Availability, Changes, and Termination

We may add, change, suspend, limit, or discontinue any part of the Service, and may change these Terms, at any time, with or without notice, and without liability to you. We do not guarantee any level of availability or uptime. Either of us may end the arrangement at any time; on termination your access ends and, consistent with the “Alpha service” notice above, no refunds are given. The provisions that by their nature should survive — including the disclaimers, the no-reliance-on-AI provision, the limitation of liability, and the indemnification — continue to apply after termination.

12. Your Data

You are responsible for your own data and for keeping your own backups. We do not warrant against and are not liable for any loss, corruption, or unauthorized access to data. We may access, use, and disclose data as needed to operate and support the Service, to enforce these Terms, and to comply with law. Our handling of personal information is described in our Privacy Policy, if published.

13. General

If any provision of these Terms is held unenforceable, the rest remains in effect and the unenforceable provision is limited or removed to the minimum extent necessary. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may. These Terms are the entire agreement between us regarding the Service and supersede any prior understandings. Your continued use of the Service after any change to these Terms constitutes acceptance of the change.

By paying for, subscribing to, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including the “as is” disclaimer (Section 3), the no-reliance-on-AI provision (Section 4), the limitation of liability (Section 8), and the indemnification (Section 9).
